Foreigners residing in or interacting commercially within Mexico enjoy the same consumer rights as Mexican nationals, including access to truthful advertising, clear contract terms, fair pricing, and mechanisms to challenge abusive practices. The law also regulates adhesion contracts, warranties, and commercial promotions, ensuring transparency and preventing misleading or fraudulent conduct in the marketplace.
PROFECO, the Federal Consumer Protection Agency, is the main authority responsible for enforcing consumer rights. It oversees compliance with consumer‑protection regulations, investigates complaints, conducts inspections, and can impose sanctions on businesses that violate the law. Foreign consumers may file complaints with PROFECO regarding defective products, abusive clauses, misleading advertising, or service failures. The agency also facilitates conciliation procedures between consumers and suppliers, offering an accessible dispute‑resolution mechanism without requiring litigation. PROFECO’s role extends to monitoring e‑commerce practices, ensuring that online transactions meet transparency and security standards.
CONDUSEF, the National Commission for the Protection and Defense of Users of Financial Services, complements this framework by regulating consumer rights in the financial sector. It supervises banks, insurers, credit institutions, and fintech entities, ensuring that financial products are offered with clear information, fair terms, and adequate risk disclosure. Foreigners using Mexican financial services—such as bank accounts, loans, insurance, or investment products—may file complaints with CONDUSEF and participate in conciliation processes. The commission also issues binding recommendations, publishes transparency indexes, and promotes financial education to strengthen consumer decision‑making. Together, PROFECO and CONDUSEF form a comprehensive system that protects consumers across both commercial and financial markets.
